Florida Speeding Law

Florida Statues §316.183 defines the rules regarding speeding. When you are issued a speeding ticket, you generally have three options.

  1. Pay a set fine;
  2. Attend traffic school; or
  3. Dispute the ticket in court.

Keep in mind that if you decide to attend traffic school, you will still have to pay a fine, although, in that case, the fines will be somewhat lower. If you decide to fight your ticket in traffic court, make sure that you speak to an experienced speeding ticket lawyer first for the best chance at winning.

Fines & License Points

Fines vary by location. In Orange County, the amount depends on how much above the speed limit you were allegedly driving. The following includes a general breakdown of speeding fines.

  • 6–9 MPH over the speed limit — $129, 3 points off license
  • 10–14 MPH over the speed limit — $204, 3 points off license
  • 15–19 MPH over the speed limit — $254, 4 points off license
  • 20–29 MPH over the speed limit — $279, 4 points off license
  • 30+ MPH over the speed limit — $300+, a court hearing, and 4 points off license

Bear in mind that these are general estimates and may not accurately reflect the exact amount owed. For instance, fines may be doubled in school zones or near construction sites.

Insurance

Most insurance companies may also use a speeding violation against you, labeling you a “reckless driver,” which causes your insurance premium rates to skyrocket.

License Suspensions

If you receive 12 points off your license in one year, your license will be suspended for 30 days. If you receive 24 points in three years, your license will be suspended for one year.

For those holding a commercial driver’s license (CDL), penalties will be higher. You may receive a 60 or 120–day disqualification for speeding tickets depending on the severity of the infraction. If you are towing a trailer, your license may also be indefinitely suspended. Also, keep in mind that speeding tickets issued on your license may also lead to CDL disqualifications and suspensions. A CDL disqualification or suspension will most likely cause you to lose your job if your employer requires you to have a CDL license.
